Jefferson County Prosecutor Chad Lewis said Monday his office will dismiss 63 pending criminal cases investigated by a Madison Police Department officer who was arrested last week.

Josh A. Abbott, 32, was arrested Feb. 3 on allegations of domestic violence. He has been charged with multiple felonies, including one alleged instance of pointing a gun at his girlfriend. He is being held in the Jefferson County Jail.

Lewis said each of the dismissed cases involve Abbott as a "crucial officer," which includes any cases he primarily investigated, individually made the arrest or played a significant role in charges being filed.

Of the cases being dismissed, 29 are felonies - four of them Class C felonies, which are punishable by a maximum of eight years in prison.

Most of the arrests by Abbott were made after a traffic stop.

Sheriff John Wallace said that of the people whose charges were being dismissed, two were being held in the Jefferson County Jail. They were released Monday.

Following Abbott's arrest, prosecutors announced they would review all pending cases involving Abbott and decide how to proceed.

Lewis said the decision whether or not to dismiss came from reviewing each case and determining if they had enough evidence after excluding any testimony that would come from Abbott. If the prosecution could not make the case without him, the charges were dismissed.

"While Mr. Abbott is presumed innocent until proven guilty, the prosecutor's office cannot in good faith continue to prosecute members of our community based on Mr. Abbott's work as a police officer," Lewis said in a news release.

"We have an obligation to protect our community's sense of justice, along with the integrity of the criminal court system. I have always told my prosecutors that ethics comes first, and that it's our job to do justice."
