Grandview to be sold at sheriff's sale

Grandview Memorial Gardens cemetery will be sold at a sheriff's sale scheduled for Feb. 23.
The sheriff's sale is the result of River Valley Financial Bank filing foreclosure against the cemetery in 2009.
The sale is scheduled for 10 a.m. at the sheriff's office.
The defendants in the foreclosure were James R. "Jim" Holt, Sherill J. Holt, Brent J. Holt, Madison Funeral Service Inc., J.R.B. Enterprises Inc., Mainstreet Investments Inc., James R. "Rob" Holt II, Wilma C. Vail, her unknown heirs and/ or devisees, MainSource Bank and Grandview Memorial Gardens LLC.
As part of a settlement agreement with River Valley Financial Bank in June 2011 involving other properties, Jim Holt agreed to help River Valley foreclose on the cemetery.
The ownership of the cemetery was disputed in lawsuits filed in 2006 that are still pending in court.
Keith Mefford, the registered agent for Grandview Memorial Gardens LLC - one of the defendants in the foreclosure - bought the cemetery on contract in 2005 from Madison Funeral Service Inc., of which Jim Holt is the registered agent.
Holt sold the corporation, Madison Funeral Service Inc., to Larry Fox, who at the time was an insurance agent who sold prepaid funerals.
Madison Funeral Service Inc. and Mefford's Grandview Memorial Gardens LLC sued each other in June 2006 over the question of who owned the cemetery.
Mefford said recently he is still working at the cemetery while the ownership is in dispute.
The 41.2-acre Grandview cemetery is at 9306 U.S. 421.
The legal notice for the sheriff's sale was published Friday.
