The Madison Plan Commission filed a lawsuit against the owner of a junkyard over an alleged violation of the city's zoning ordinance.
The suit was filed in Jefferson Circuit Court against Chuck Johnson and his property at 2914 Clifty Drive.
According to the complaint, the property is currently zoned as a general business district. A junkyard, the complaint reads, does not qualify as a permitted use for a general business district.
The city is seeking intervention from the court because Johnson has been operating the junkyard said December 2010, according to affidavit.
The city is requesting a decree for Johnson to cease working at the junkyard and for the court to impose fines of up to $10,000 per day if Johnson continues to operate the junkyard.
