Prosecutors will not to file charges against a Madison man arrested Friday. Rodger J. Brown, 54, was arrested by Madison police on charges of intimidation and pointing a firearm. Prosecutors dismissed the case because they could not prove beyond a reasonable doubt that Brown had not been acting in self defense.

Prosecutor Chad Lewis said an unwelcome person was in Brown's home and Brown asked the man to leave. When he refused, Brown retrieved a gun in an attempt to force the man from his home.

Lewis said there was probable cause at the scene to support Brown's arrest, but the full facts of the case did not support the charges.

"Ultimately, we believe homeowners have the right to use weapons to get rid of unwanted guests or a trespasser at their home," Lewis said.
